Mike Pence, who served as vice president during Donald Trump’s first term, has praised a ruling by the Supreme Court of the United States striking down tariff powers claimed by the president.
He described the judgment a victory for Americans and the US Constitution.
Reacting in a post on X to the court’s 6–3 decision in Learning Resources, Inc. v. Trump, Pence said the ruling reaffirmed that the authority to impose taxes lies with Congress, not the president.
“Today’s 6-3 ruling by the Supreme Court is a Victory for the American People and a Win for the Separation of Powers enshrined in the Constitution of the United States,” Pence wrote.
“In Learning Resources, Inc. v. Trump, our Supreme Court has reaffirmed that the Constitution grants Congress, not the President, the power to tax.”
Pence also argued that tariffs ultimately burden Americans rather than foreign countries.
“American families and American businesses pay American tariffs, not foreign countries. With this decision, American families and businesses can breathe a sigh of relief.”
The former vice president noted that his advocacy organisation, Advancing American Freedom, participated in the legal fight through an amicus brief supporting limits on executive power.
“I’m proud of the work our organisation has done on this case through our robust amicus brief programme to advance economic freedom and defend the Constitution,” he said.
He added that the ruling could help restore a constitutional path toward freer trade.
“With this historic decision, America can now return to the pursuit of Free Trade with Free Nations under the Constitution of the United States.”
In a follow-up post, Pence also highlighted remarks from Justice Neil Gorsuch in a concurring opinion in the case.
“Wisdom and Principle from Justice Neil Gorsuch’s Concurring Opinion in the Tariff case,” Pence wrote before sharing the excerpt:
“For those who think it important for the Nation to impose more tariffs, I understand that today’s decision will be disappointing. But if history is any guide, the tables will turn and the day will come when those disappointed by today’s result will appreciate the legislative process for the bulwark of liberty it is.”
The comments are notable given Pence’s previous role as Trump’s running mate, highlighting a rare instance where the former vice president has publicly celebrated a legal setback for policies associated with the administration he once served in.
