In response, the prosecutor, Mr. Onine told the Court that though bail is at the discretion of the Court and he is not against the court admitting the defendant to bail, but the matter before the Court is that of conspiracy and stealing, and that court should grant bail on the said count.

Probing further to know if the complainant and the defendant are a couple, the presiding magistrate, Helen Omisore, asked from Moses Ojiekomhan what transpired between them.

Ojiekomhan said: “We once lived together as husband and wife, but we have now separated. They have charged me to court for child abduction.

“I caught Emeka, who is a driver in my company, sleeping with her in my house.”

To complement what Moses’ story, the prosecutor said according to the police investigation into the matter which revealed that Moses and Joy were once husband and wife, but they separated when Joy and Emeka (the driver) who is now at large, were caught in immoral act.

To also compliment what he and the prosecutor told the court, the defendant’s lawyer, said that the husband took away an 18 month-old baby from the defendant, and Court 4 Ogba Chief Magistrate Court, had issued a warrant of arrest against him.

Joy’s lawyer also told the Court that in order to prevent his client from being in court tomorrow, that is why the police charged his client to court today.

To be sure of the stories from all parties, the presiding magistrate called for the case file, and after perusing the case file, she admitted the defendant to bail in the sum of N500, 000, with two sureties.

Magistrate Omisore also ordered that one of the sureties must be a blood relation to the defendant, who has three years tax certificate payable to the Lagos State government. She said that both the home and office address of the sureties must be verified by the prosecutor.

The Magistrate then adjourned the matter till September 27, for mention.
