Court Restrains TUC from Holding 12th Delegates Conference, Puts National Officers’ Elections On Hold

The National Industrial Court of Nigeria, granting the prayer of 10 labour unions, has restrained the Trade Union Congress of Nigeria (TUC) and its officials or representatives from holding the planned 12th delegates conference.

The Order of Interlocutory Injunction signed by Justice R.H. Gwandu and Registrar, Terkaa Yankyaa, in respect of Suit No. NICN/LA/ 242/2022, dated July 6, 2022, at the Lagos Judicial Division, ordered that the TUC and any of its representatives must not hold the 12th delegates conference or elect any National Officer pending the hearing and determination of the Motion, filed by 10 senior staff associations.

The case comes up for hearing on Monday, July 18, 2022.

In the Interlocutory Injunction, the judge states that:

“It Is Hereby Ordered as Follows:

■ That I hereby grant the Interlocutory Order as prayed on the claimant’s Motion paper dated and filed on 16/6/2022.

■ That the matter is adjourned for hearing on the 18/7/2022.”

The injunctions seekers include: 

●Association of Senior Staff of Banks, Insurance and Financial Institutions (ASSBIFI),

●Pulp Paper And Paper Products Printing And Publishing Senior Staff Association of Nigeria, (PPAPPPAPSAN),

●Nigeria Merchant Navy Officers And Water Transport Senior Staff Association of Nigeria (NMNO/WTSSA),

●Senior Staff Association of Shipping, Cleaning, and Forwarding Agencies

●Air Transport Service Senior Staff Association of Nigeria (ATTSSSAN) among others.

The other five Associations who signed the Motion are:

●Precision, Electrical And Related Equipments Senior Staff Association (PERESSA),

●Shop And Distributive Trade Senior Staff Association (SHOPDIS), ●Textile, Garment and Tailoring Senior Staff Association Of Nigeria (TGTSSAN),

●Senior Staff Association of Universities Teaching Hospitals, Research Institutes and Associated Institutions (SSAUTHRIAL) and,

● Automobile, Boatyard, Transport, Equipment and Allied Senior Staff Association of Nigeria (AUTOBATE).

After reading, the affidavit in support of the Motion Ex parte was deposed to by Benedict Ikegbulam, General Secretary of PPAPPPAPSSAN.

After hearing, Timothy Adewale (for the Claimants/Applicants, Ambassador Sola Iji with Femi Abimbola (for the Defendant), and Johnson Esezoobo with Vivian C. Duru for the party, sought to be joined.
