The Supreme Court today dismissed the appeal filed by the Peoples Democratic Party and its governorship candidate in the September 2018 election in Osun State, Ademola Adeleke, challenging the election of Governor Adegboyega Oyetola of the All Progressives Congress.
The Supreme Court in a majority decision of 5-2 read by Justice Olabode Rhodes-Vivour held that the failure of a member of the electoral tribunal, Justice Peter Obiora to sit on February 6, 2019, rendered the entire proceedings and the judgement given by the tribunal a nullity.
The Court upheld the majority judgement of the Court of Appeal, which upheld Oyetola’s victory as the Governor, State of Osun.
