An Oyo State High Court sitting in Oyo town has fixed Thursday, November 9, 2023, for the hearing of a fresh suit filed by a faction of Oyomesi against Governor Seyi Makinde and four others.
Justice Ladiran Akintola had struck out an earlier suit sequel to its withdrawal by the claimants.
The claimants are, Basorun of Oyo, Chief Yusuff Akinade Ayoola; Lagunna of Oyo, Chief Wakeel Oyedepo; Akiniku of Oyo, Chief Amuda Yusuf; Areago Basorun, Chief Waheed Oyetunji and Alapo, Chief Gbadebo Mufutau.
At the resumed hearing of the earlier suit yesterday, the claimant’s lawyer informed Justice Akintola he had filed an application for discontinuance and had at the same time filed a fresh suit marked, HOY/14/2023, as a replacement.
He prayed the court to proceed to hear the new suit but Justice Akintola declined the request.
In his response, the judge said, “The case file has to be looked into before the date for the hearing will be fixed. The date for the hearing will be communicated”.
While addressing journalists outside the courtroom, the state’s attorney general and commissioner for justice, Abiodun Aikomo, who is the second defendant in the matter, said the claimants withdrew the old suit “perhaps to correct some of the errors in their process or to improve their case”.
